General Booking Terms and Conditions – Domaine de Ti Coin
Article 1 – Purpose of the Contract
This seasonal rental agreement is exclusively reserved for the rental of accommodations operated by SARL AGREPE. Under no circumstances shall SARL AGREPE be held liable for any use of this contract by third parties or for purposes other than tourism-related accommodation.
Article 2 – Duration of Stay
The tenant signing this fixed-term agreement shall not, under any circumstances, claim any right to remain on the premises after the agreed departure date.
Article 3 – Formation of the Contract
The reservation becomes effective once the tenant has paid a deposit of 30% of the total rental amount and returned a signed copy of the contract before the date specified. The rental agreement may not, under any circumstances, benefit third parties (natural or legal persons), even partially, without the prior written consent of the owner. Any breach of this provision may result in immediate termination of the rental at the tenant’s expense, with all amounts paid remaining permanently retained by the owner.
Article 4 – No Right of Withdrawal
For bookings made by mail, telephone, or internet, the tenant does not benefit from any right of withdrawal, in accordance with Article L121-20-4 of the French Consumer Code relating to accommodation services provided on a specific date or period.
Article 5 – Cancellation by the Tenant
All cancellations must be notified in writing (email, WhatsApp, or mail). The tenant must ensure within a maximum of three (3) days that the owner has received and acknowledged the cancellation.
a) Cancellation before arrival:
The deposit remains non-refundable and retained by the owner. If cancellation occurs less than 30 days before arrival, the owner reserves the right to claim the full balance of the stay. If the tenant does not appear within 24 hours after the scheduled arrival time without notice, the contract becomes null and void, and the owner may re-let the property. The full rental amount remains due.
b) Early departure:
If the stay is shortened, the full rental amount remains payable. No refund shall be granted.
Article 6 – Cancellation by the Owner
In the event of cancellation by the owner, all sums paid shall be refunded to the tenant, plus compensation equal to 30% of the amounts paid.
Article 7 – Arrival
The tenant must arrive on the specified date and time indicated in the contract. In case of late or delayed arrival, the tenant must inform the owner.
Article 8 – Payment Methods and Balance
Accepted payment methods:
- Cash (within legal limits)
- Bank transfer (bank details provided upon confirmation)
- Credit card (Visa, MasterCard, American Express)
- PayPal – A 3% additional fee will be added to cover transaction costs.
Balance payment:
The remaining balance must be paid 15 days before arrival.
Article 9 – Inventory and Condition Report
An inventory and condition report shall be established jointly and signed at arrival and departure. This document shall be the sole reference in case of dispute. The tenant is responsible for maintaining cleanliness during the stay. Exceptional end-of-stay cleaning fees may apply as stated in the house rules.
Article 10 – Security Deposit
A security deposit, as specified in the contract, is required upon arrival. The deposit is secured exclusively by credit card pre-authorization and shall not be charged unless damages or breaches are identified. It will be released within a maximum of 8 days after key return, provided no damage, missing items, or unpaid charges are identified. If the deposit is insufficient to cover damages, the tenant agrees to pay the remaining balance upon justification.
In case of early departure preventing same-day inspection, the deposit will be released within one week.
Article 11 – Use of the Premises
The tenant agrees to use the property peacefully and in accordance with its intended residential purpose.
Article 12 – Capacity
The maximum occupancy is strictly limited to two (2) persons. If occupancy exceeds this capacity, the owner may refuse additional persons. Any breach shall be considered a termination at the tenant’s initiative.
Article 13 – House Rules
All guests must comply with the internal house rules provided upon arrival.
Article 14 – Insurance
The owner insures the property against rental risks. The tenant must report any damage or incident within 24 hours.
Article 15 – Additional Charges and Tourist Tax
At the end of the stay, the tenant must pay for any additional services not included in the rental price.
Article 16 – Disputes
Any claim relating to the condition of the property must be submitted within 24 hours of arrival. Any other complaint must be submitted as soon as possible.
